The dispute concerned the question of whether the bank had acquired a claim against the debtor in the course of multiple transfers of a company and whether the claim had expired. The dispute was directed from the County Court to the Circuit Court, back to the County Court, to the Circuit Court again and from there to the Supreme Court. On the second occasion, the Circuit Court agreed with us that a dispute over a claim must be solved outside the bankruptcy proceedings, and annulled the bankruptcy declared earlier.
